The family of a Canton firefighter who was killed running across busy Route 8 in Akron in February says they're going to legally challenge the ruling of her death as a suicide.

The family of Tonya Johnson is planning a lawsuit aiming to overturn the Summit County Medical Examiner's ruling on the cause of her death.

Attorney David DuPlain is one of two lawyers representing the Johnson family. He says that the ruling of suicide isn't the only reasonable conclusion from the evidence surrounding Tonya Johnson's death.

"There's more than that, as far as the logical conclusions that one could come to from the evidence," DuPlain tells WAKR.net. "And in fact, I think that it is not the most likely of circumstances, I don't think it's the most likely truth, if you will, in taking into account all the evidence."

Friends and family of Johnson say her death was accidental, and she had called a member of her family, asking to be picked up along the highway.

They've said that she had been planning to end her brief marriage with Randey Johnson, who was in the car with her. The family says she feared for her safety.

DuPlain says the complaint will be filed in Summit County Common Pleas Court when he's reviewed the final written report by the Summit County Medical Examiner's Office.

Grove Street Body Found

The Summit County Medical Examiner is looking into the death of a man found dead in a parking lot on Grove Street just after nine Tuesday morning.

Akron police found the man unresponsive, dead of an apparent gunshot wound.

The Medical Examiner says the shooting was a homicide.

No positive identification has been made, and none will be released pending notification of next-of-kin.

The Summit County Medical Examiner's Office has officially identified all nine victims killed in last week's jet plane crash in Ellet.

The final identification came Friday, of pilot 40 year-old Oscar Chavez and co-pilot 50 year-old Renato Marchese, both of Florida.

The seven passengers, all employees of a Florida real estate firm, were identified earlier.
